Terms & Conditions for “Booking” a Space

CREATING A BOOKING SPACE ACCOUNT

The Welcome & Opportunity Training Center are available to rent for representatives of an organization or individuals above the age of 18. By creating a booking space account you agree to provide us with accurate and complete information about yourself or the organization. You agree to not falsely represent your association with any company, impersonate any third party or otherwise submit any false or misleading information to us. You are responsible for maintaining the confidentiality of your password and access to your account. 

If you are an authorized representative of your organization or employer you hereby warrant and represent to us that you have the proper authority to create and terminate the company account, add and remove company information, and include payment or invoicing information for the account and agree to indemnify us for any loss we may suffer as a result of any breach of this warranty and representation.

Booking a Space 
Your account allows you to ‘book a space.’ When your request is reviewed by the Opportunity and Entrepreneurship Coordinator you will be sent a payment link. By ‘booking a space’ you agree to pay us the fees as displayed at the time you make your request. You acknowledge and agree that the payment information provided in the account will incur charges as displayed at booking. Your use of the services may be suspended if we are unable to charge such payment instrument for any reason or if invoices are not paid via the terms. 

If your ‘booking space request’ is NOT approved your account will not be charged. 

Cancellation

You must contact the Entrepreneurship and Opportunity Coordinator to cancel your request. Cancellations made 2 weeks in advance will be fully refunded. Cancellations made up to 3 days in advance may be subject to a cancellation fee of up to 50% of the total charged. Cancellations made within 2 business days or less will be charged the full amount displayed at ‘booking’. Refunds will be made to the payment instrument on file and will be processed manually by a team member of The Center after the requested cancellation. All refunds will be processed within 7-10 business days after the request depending on the payment instrument identified in your account. 

Account termination. 

If you fail, or if we suspect that you have failed, to comply with any of the provisions of these terms, we may, at our sole discretion and possibly without prior notice to you, restrict your access to your account and our services and/or terminate your account with immediate effect. 

Monetary Transactions via Credit/Debit Cards

The Center uses the 3rd party payment platform, Stripe, the Stripe API, and in conjunction, your Stripe account to process credit and debit card transactions. By using the Stripe Check Out you agree to be bound by Stripe’s Terms of Service.

You expressly understand and agree that The Center shall not be liable for any payments and monetary transactions that occur through Your use of the Service. You expressly understand and agree that all payments and monetary transactions are handled by Stripe. You agree that The Center shall not be liable for any issues regarding financial and monetary transactions between You and any other party, including Stripe.

You are responsible for all transactions (one-time, recurring, and refunds) processed through the Service and/or Stripe. The Center will act as a broker to process any refunds, but all refunds will occur through your Stripe account. The Center is not liable for loss or damage from errant or invalid transactions processed with Your Stripe account. This includes transactions that were not processed due to a network communication error, or any other reason. If You process a transaction, it is Your responsibility to verify that the transaction was successfully processed.

You understand that The Center uses the Stripe API to run the Service and that the Stripe API is subject to change at any time and such changes may adversely affect the Service. You understand and agree to not hold The Center liable for any adverse effects that actions (whether intentional or unintentional) on the part of Stripe may cause to Your Stripe account, or Your business.

You must not process stolen credit cards, or unauthorized credit cards through Stripe.

All transaction information passed between The Center and Stripe's systems is encrypted. No cardholder information is ever passed unencrypted. You can be completely assured that nothing we pass to Stripe's servers can be examined, used or modified by any third parties attempting to gain access to sensitive information.

USING OUR LOCATION
By ‘booking a space’ you also agreeing to following general guidelines regarding conduct and expected behavior at The Center. In general the The Center and the Welcome Center & Opportunity Training Center are “welcoming” places and reflect our vision of many cultures one community.  In general, we expect that you will not perform any activity that is reasonably likely to be disruptive, damaging or dangerous to our property, our employees, or individuals using The Center services. You may not use our space or services in a manner that: promotes or incites racism, bigotry, hatred or physical harm of any kind against any group or individual; bullies, defames, harasses or advocates stalking of, or the intimidation of another person; involves pornographic or obscene materials; is harmful, abusive, threatening, offensive, defamatory or libelous; invades the privacy or discloses the private information of anyone; violates someone’s right of publicity; impersonates others or in a manner intended to or does mislead or confuse; is used for unlawful purposes or for promotion of dangerous and illegal activities; involves spamming or the sending of mass solicitations; implies that any statements you make are endorsed by us; is false, deceptive or misleading, or misrepresents or deceives others as to the source, accuracy, integrity or completeness; infringes any intellectual property or proprietary rights of others; transmits any restricted, confidential or proprietary information of others; or transmits content prohibited under any law, rule or court order, or prohibited as a result of any employment, contractual or other legal obligation or relationship.

If you are representing an organization your behavior will be reported. If your behavior is illegal, threatening, harmful or in any other way indicates harm to others authorities will be contacted. Engaging in any of the above mentioned behavior makes you subject to removal from our property and the inability to access our space or services in the future.

Security
For security purposes, we regularly record via video certain areas of our location. We also require that you take responsibility for letting in clients you may be transacting business with and must be on-premise. 

You may be required to present a valid, government-issued photo identification in order to gain access to our locations.

Personal Property
We are not responsible for any property you may leave behind in our location. It is your responsibility to ensure that you have retrieved all of your personal items prior to leaving. If we find items left in the space we will do our best to notify and retain such items until they can be retrieved. 

Damage
You may be held liable (and do hereby authorize us to charge you) for the repair cost for all damage to our locations and items therein caused by you or your clients.

Common Areas
Common spaces in our locations are to be accessed by you and your clients in the time immediately prior to and following your reserved time in the location. They are for temporary use and not as a place for continuous, everyday work. 

INDEMNIFICATION
You agree to indemnify and hold harmless us (The Center), our officers, directors, employees, agents, representatives and affiliates, and our third party providers and partners, from any claims, damages, losses, costs, reasonable attorneys’ fees or other expenses that arise directly or indirectly out of or from your violation of the terms of service, your use of our services, or any information, content or materials contained, displayed or available therein, by you or any other person accessing them under your authorized access methods, your violation of the rights of any third party or your submissions, except in each case to the extent any of the foregoing arises directly out of our gross negligence or willful misconduct.

You agree to cooperate with us. From time to time, we may investigate any actual, alleged or potential violations of these terms of service. You agree to cooperate fully in any of these inquiries. You waive any and all rights against us, our officers, directors, employees, agents, representatives and affiliates, and agree to hold them harmless in connection with any claims relating to any action taken by us as part of our investigation.
